  • Chapter 7, or liquidation bankruptcy, is a type of bankruptcy in which all of a person's debts are quickly discharged, and some of the debtor's property may be taken to satisfy the debts. In Florida, a debtor has exemptions that will help protect your property from loss. Under the bankruptcy law passed in 2005, Chapter 7 is often only available to individuals or couples with income below the median in their area. In today's real estate market, however, investors may be able to access Chapter 7 regardless of income, depending on the nature of their debts.
  • In a Chapter 13 bankruptcy, a person enters into a payment plan of 36 or 60 months, to pay back as much of their debts as possible over the life of the plan. This type of bankruptcy is used most often when a debtor's income is too high to qualify for Chapter 7, or when the debtor's home is facing foreclosure. A Chapter 13 bankruptcy can allow you to stop a foreclosure and give you time to bring your loan up to date.
