Qualifying for Chapter 7 Bankruptcy: the Means Test
In order to qualify for Chapter 7 Bankruptcy, your monthly income after expenses must be below the median in your area. We can explain the means test and calculate if you are eligible for Chapter 7. Certain debts cannot be discharged, including student loans and child support. Some of your personal and real property may be covered by an exemption, for instance, there is one for homestead property.
In order to file, you must have copies of the following documents:
- Last year's tax return
- Pay stubs
- A list of monthly obligations, including credit card, mortgage and car loan debt
- A list of property you own, including your home, cars and valuables
- Other monthly expenses, including utilities and child support payments
