What is elder law?

There is no doubt that it is important for society to look out for its most vulnerable members. These include children and the elderly. This has led to a specific area of law developing to focus on the older members of society. Elder law helps to watch out for issues specific to the older generation. This area of law focuses on concerns that affect the elderly and may require special consideration when applied to this age group in Florida.

The ABA Journal explains that while elder law covers areas specific to seniors, some areas may overlap with other areas of law that pertain to people regardless of age, but elder law specifically focuses on how those legal areas pertain to senior citizens. For example, guardianship is not an issue that is specific to older people, but when it involves Alzheimer’s disease, it generally is a senior issue. Other areas elder law may focus on include Medicare, inheritance and estate issues and elder abuse.

There is a growing need for the practice of elder law. The older population is increasing thanks to baby boomers reaching their senior years and people living longer. The U.S. will experience a shift in the population leading to an incredibly larger number of older Americans than children. It creates a need for elder law and those who practice in this area like never before.

As you age, it is a good idea to become familiar with this area of law. You may very well need assistance with the many issues it covers.
